AquaGo Explorer Terms of Service

Welcome to AquaGo Explorer ("AquaGo" or the "Service"). AquaGo is provided and operated by Chao Pei Ru, an individual developer located in Taiwan ("we," "us," or "our").

By creating an account or accessing or using AquaGo, you acknowledge that you have read and agree to these Terms of Service and the Privacy Policy. If you do not agree, do not use the Service. If you have not reached the age of majority where you live, a parent or legal guardian must review and agree to these Terms.

These Terms supplement Apple's Standard End User License Agreement applicable to App Store apps. If these Terms conflict with consumer rights that cannot lawfully be excluded, the mandatory legal protections control.

1. The Service

AquaGo uses artificial intelligence to provide marine-life identification from underwater photos, identification history, location tagging, and related features.

Features, supported devices, usage allowances, and plan contents are as displayed in the app at the relevant time. We may update features to improve performance, security, or the user experience.

2. Eligibility and Minors

AquaGo is not specifically directed to children. Children under 13 may not independently create an account or use the Service.

Anyone who has not reached the age of majority where they live must have a parent or legal guardian agree to these Terms and must use AquaGo under their guidance. The parent or guardian is responsible for the minor's use of the Service.

3. Accounts

AquaGo currently uses Sign in with Apple to create and authenticate accounts. You must use your own Apple account and are responsible for maintaining the security of your device and account.

The same user may sign in on supported devices using the same Apple account. Usage allowances and subscription eligibility are calculated based on the account recognized by AquaGo. You may not sell, rent, transfer, lend, or share an account or make its identification allowance available as a service to another person.

4. Free, Premium, and Usage Allowances

The current plans are generally described below. The benefits, prices, and billing periods displayed in the app at the time of purchase control.

Free

• Up to 30 Fast Identifications per month.

AquaGo Premium

• Up to 300 Fast Identifications per month;
• Batch Upload, allowing selection of up to 10 photos per submission;
• Up to 30 Deep Identifications per month;
• species location tagging and other Premium features shown in the app.

Each photo submitted for identification generally consumes one corresponding identification allowance. Deep Identification accepts one photo per submission.

Both Free and Premium are subject to monthly allowances; Premium is not an unlimited-use plan. Once an allowance is exhausted, the corresponding identification feature becomes unavailable until the next usage period begins or another allowance becomes available.

To protect accounts, the Service, and computing resources, AquaGo may apply separate short-term rate limits. Currently, a user may process up to 30 photos in a 60-second period. If this limit is exceeded, you must wait and try again. This rate limit is separate from the monthly allowance. We may reasonably adjust technical limits for security, stability, or abuse prevention.

Unused monthly allowances do not roll over to the next period unless the app expressly states otherwise.

5. Subscriptions, Payment, and Cancellation

AquaGo Premium offers monthly and annual auto-renewable subscriptions and currently does not offer a free trial. The plan price, currency, period, and current benefits are those displayed on the App Store purchase screen when you confirm payment.

Apple processes subscription payments through the App Store and In-App Purchase system. Subscriptions automatically renew under the terms displayed by Apple until you cancel through Apple.

You can view or cancel a subscription through your Apple account subscription settings. After cancellation, you can generally continue using Premium through the end of the paid period, subject to the subscription status displayed by Apple. Cancellation does not delete existing identification history.

Deleting the AquaGo app or your AquaGo account does not automatically cancel your Apple subscription.

Payments, charges, taxes, cancellations, and refund requests are handled under Apple's rules and applicable law. AquaGo does not directly collect payment or approve App Store refunds. If you believe a charge is incorrect, submit a request through Apple's Report a Problem service or Apple Support.

6. User Photos and Other Content

You retain your rights in photos and content you upload. AquaGo does not acquire ownership merely because content is uploaded.

Although AquaGo does not require that every photo be taken by you personally, you may upload only content that you have the right to use and authorize AquaGo to process. You are responsible for ensuring that the upload, processing, and licensed use described in these Terms do not infringe copyright, trademark, privacy, publicity, or other rights. If a photo contains an identifiable person, you are responsible for obtaining any consent required by law.

You grant us a worldwide, non-exclusive, royalty-free license to store, reproduce, transmit, reformat, analyze, and process uploaded content only as necessary to:

• provide AI identification and related features;
• retain and display your identification history;
• maintain, protect, and improve AquaGo;
• evaluate or improve identification systems and AI models in accordance with the notice and consent provided to you;
• enforce these Terms and comply with legal obligations.

AquaGo will not make your photos or identification results available to other users or the public without your separate consent.

After you request permanent deletion of a photo under the Privacy Policy, we will stop using the deleted source file for future training, evaluation, or improvement. However, if a photo was already used to train or evaluate a version of an AI model before you requested deletion, that training or evaluation is already complete — we cannot remove or reverse that data's contribution to the already-trained model, and deleting the source photo will not and cannot undo the effect it already had on that model. Aggregated statistical information that was lawfully created and cannot reasonably be linked back to an individual is also unaffected.

The license in this section is limited to purposes necessary to operate and improve AquaGo. It does not authorize us to sell your personal data.

7. Important AI Limitations

AquaGo results are generated by artificial intelligence and may be incorrect, incomplete, outdated, or may confuse visually similar species. We do not guarantee the accuracy, completeness, timeliness, or suitability of any result.

AquaGo does not provide, and must not replace:

• dive planning, route, environmental, or personal-safety judgment;
• medical diagnosis, poisoning treatment, or emergency assistance;
• a determination that an organism is safe, toxic, harmful, or edible;
• a decision to touch, capture, feed, approach, or otherwise interact with marine life;
• the sole basis for scientific research, law enforcement, conservation reporting, or formal species identification.

Users must independently evaluate conditions and consult qualified professionals and reliable sources. In a situation involving possible danger to life, health, or safety, contact local emergency services or a qualified professional and do not rely on AquaGo.

8. Third-Party Services

AquaGo uses Apple, Vercel, Google Cloud, the Google Gemini API, OpenRouter, and other necessary service providers. Third-party services may be governed by their own terms and policies.

An interruption, restriction, or change to a third-party service may make part of AquaGo temporarily or permanently unavailable. To the extent permitted by law, we are not responsible for a third-party service itself, third-party content, or a third party's independent conduct.

9. Prohibited Conduct

You may not:

• violate applicable law or infringe another person's rights;
• upload unlawful, infringing, threatening, hateful, pornographic, exploitative, severely violent, malicious, or harmful content;
• upload, copy, or use another person's content or personal data without appropriate rights or consent;
• distribute malware, viruses, or other harmful code;
• circumvent monthly allowances, rate limits, access controls, or security measures;
• use bots, automation, or abnormal request volumes to disrupt the Service;
• reverse engineer, probe, scan, or attempt to obtain AquaGo source code, models, systems, keys, or non-public data, except where applicable law expressly permits;
• access another user's account or data without authorization;
• resell, rent, transfer, or otherwise provide an AquaGo account, allowance, or identification service to a third party;
• impersonate another person or engage in fraud or deception;
• use AquaGo in a way that could damage, disable, overload, or impair the Service.

We do not sell user personal data. See the Privacy Policy for applicable processing and sharing practices.

10. Suspension and Termination

If we reasonably believe that you have violated these Terms, abused the Service, infringed another person's rights, or created a legal, security, or technical risk to AquaGo, users, or third parties, we may provide a warning, require corrective action, limit features, suspend the account, or terminate access.

Except in cases involving an urgent security risk, serious illegality, fraud, attack on the Service, or another circumstance where prior notice would be inappropriate, we will provide notice where reasonably practicable.

You may stop using AquaGo at any time and may delete your account through the in-app process. Account deletion, backend retention, and permanent deletion requests are governed by the Privacy Policy. Deleting an account does not automatically cancel an Apple subscription.

Provisions that by their nature should survive termination — including content rights, completed processing, limitations of liability, dispute provisions, and legal obligations — continue to apply after the account or these Terms terminate.

11. Changes, Interruptions, and Discontinuation

We may add, modify, suspend, or remove features for maintenance, security, legal, technical, or product-improvement reasons. We will provide reasonable advance notice of a material adverse change to a paid plan where reasonably practicable and will handle it under applicable law and Apple's rules.

We do not guarantee that the Service will always be uninterrupted or error-free. Maintenance, networks, third-party services, equipment failure, force majeure events, or other factors may cause temporary interruptions.

If we plan to discontinue AquaGo as a whole, we will generally provide at least 30 days' notice through the app, website, email, or another appropriate method. Subscription cancellation, paid periods, and refunds remain subject to Apple's rules and applicable law. Urgent legal, security, or other events beyond our reasonable control may prevent complete advance notice.

12. Intellectual Property

Except for user content and third-party content, AquaGo's app, website, interface, design, software, trademarks, database structure, and other Service materials are owned by us or the relevant rights holders.

Subject to your compliance with these Terms and Apple's applicable rules, we grant you a limited, personal, non-exclusive, non-transferable, revocable right to use AquaGo on supported devices you own or control. Downloading the app, subscribing, or using the Service does not transfer ownership of AquaGo to you.

13. Disclaimer

To the maximum extent permitted by applicable law, AquaGo is provided "as is" and "as available." We do not guarantee that the Service will meet every particular purpose, remain continuously available, be error-free, or that identification results and third-party content will be completely accurate.

These Terms do not exclude warranties, consumer rights, or liabilities that cannot lawfully be excluded or limited.

14. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, punitive, or consequential damages, or for loss of data, opportunity, profit, or goodwill arising from the use of or inability to use AquaGo.

This limitation does not apply to liability caused by intentional misconduct or gross negligence, personal-injury liability that cannot be limited, non-excludable consumer-protection obligations, or any other liability that applicable law does not permit us to limit.

15. Changes to These Terms

We may update these Terms to reflect changes in the Service, plans, technology, or law. The latest revision date will be displayed on this page.

If a change materially affects your rights or a paid service, we will provide reasonable advance notice through the app, website, email, or another appropriate method where reasonably practicable. If applicable law requires renewed consent, we will ask you to confirm before continuing the relevant Service.

16. Governing Law and Disputes

These Terms are governed by the laws of the Republic of China (Taiwan), without limiting mandatory consumer rights under the law where you live.

If a dispute arises, please first contact us at hello@aquago-app.com to seek an informal resolution. If litigation remains necessary, the parties agree that the Taiwan Taipei District Court will be the court of first instance, except where applicable law requires another venue.

17. Miscellaneous

If any part of these Terms is held invalid or unenforceable, the remaining provisions remain effective. Our failure to immediately enforce a right does not waive that right.

You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a transfer, reorganization, or succession of the Service, subject to applicable law and without reducing mandatory protections.
